What Are the Different Types of Courts in NJ?

There are five basic types of courts in New Jersey:

  • Tax courts, which hear matters related to property taxes, income tax, and other taxation issues.
  • Appellate courts, which hear criminal appeals, or challenges to sentencing and conviction decisions.
  • Municipal courts, which hear four types of offenses:
  • Boating and fishing violations.
  • Violations of municipal ordinances, such as public intoxication, open container violations, or public urination.
  • Traffic violations, such as speeding tickets or DWI in Atlantic City.
  • Disorderly persons offenses (DP) offenses and petty DP offenses, such as simple assault or marijuana possession in amounts under 50 grams, which are similar to misdemeanors in other states. DP and petty DP offenses can lead to jail time, fines, and other penalties for a defendant who is convicted.
  • Superior courts, which are sometimes called trial courts. Superior courts can hear family matters like divorce, civil matters like commercial litigation, and serious criminal matters, like murder, sexual assault, or theft in Atlantic City. These offenses, which are equivalent to felonies in other states, are called indictable crimes in New Jersey.
  • The Supreme Court of New Jersey, which is the highest court in New Jersey and has authority to reexamine the decisions of courts in the state.
