The federal indictment includes three counts, the first of which is for racketeering conspiracy under 18 U.S.C. § 1962. Racketeering is a complicated crime to explain. According to § 1961(1), racketeering involves the use of certain criminal offenses to engage in commercial profit. Often, these crimes are wrapped up in business ventures or enterprises. In short, people charged with racketeering are accused of using business deals or ventures to disguise a criminal enterprise.
In Diddy’s case, multiple businesses exist under his name. According to the federal indictment, Diddy owns businesses related to music, recording studios, marketing, television, and more. He is accused of using threats, violence, intimidation, bribery, arson, kidnapping, and other criminal offenses to get what he wants. Sex Trafficking

According to the indictment, Diddy is accused of knowingly recruiting, harboring, transporting, enticing, and maintaining victims to engage in commercial sex acts. The indictment refers to one victim, known only as “Victim 1,” as engaging in these acts by force, coercion, and fraud.
Authorities say that Diddy organized numerous sex parties he referred to as “Freak Offs.” Also, according to authorities, Diddy would hire sex workers for these Freak Offs and lure women into these events, often through promises of career opportunities, money, romance, drugs, or other tempting favors. Still, many women who participated in Freak Offs did not do so willingly. According to the indictment, those who resisted were threatened with career destruction, violence, or humiliation. Diddy allegedly had Freak Offs recorded, and recordings were often used as leverage to keep people quiet.
Transportation to Engage in Prostitution
Connected to the charges for sex trafficking and Diddy’s alleged Freak Offs are charges of transportation to engage in prostitution. Many of the people recruited to participate in these Freak Offs were sex workers that Diddy would often pay to have flown to the locations of Freak Offs. The indictment mentions numerous instances of hiring male sex workers for these events. He is charged under § 2421(a) and § 2422 for knowingly transporting people (including sex workers and victims) interstate to engage in prostitution.
How Can Diddy Possibly Defend Himself?
One possibility is that Diddy’s legal team will challenge the evidence against him. Stories regarding over 1,000 bottles of baby oil allegedly used for Freak Offs are currently making headlines. What led authorities to this and other evidence has not been revealed, but it is possible that evidence was seized illegally. The authorities must have had a search warrant to find the baby oil and other evidence seized. If they did not, or there was no valid exception to the warrant rule, Diddy might be able to have illegally seized evidence excluded from the case, weakening the charges against him.
There is a strong chance that much evidence against Diddy will come from witness testimony. He is accused of sexually abusing numerous victims and enacting violence against others. Some people were allegedly bribed to keep quiet about what they knew. Others might provide testimony in exchange for immunity from their own criminal charges. If witnesses are lying and Diddy can prove it, this would be a serious blow to the prosecution’s case.
